Over 70% of (lawyer prepared) estate plans fail. This statistic comes from observing and monitoring the estates of the upper echelons of society over a twenty year period. You may have a will and other estate documents in place but the odds are greater than seventy percent that the plan in place will fail. Treating estate planning as a mathematical equation or prioritizing tax reduction dismisses the emotional undertones that are equally important.

Many people have an inadequate relationship to money, thus they fail to understanding money issues or know how to properly communicate to prevent or solve financial problems at their foundation.

In preparing one’s estate it is not only important to put proper paperwork in place but more importantly it is essential that the relationships are in place and that the heirs are prepared. The majority of estate plans fail due to the inability to address the most essential elements of estate planning.  Estate plans are rarely designed with an understanding of the personality of the heirs in mind nor the understanding of family dynamics.
